The use of e-toll cards is considered more efficient <br>because it allows faster transactions and reduces congestion on toll roads. However, e-toll <br>cards are a form of unregistered electronic money that does not have a password or PIN. As a <br>result, the e-toll card issuer cannot provide compensation if the e-toll card is damaged or lost. <br>Therefore, e-toll card users feel disadvantaged and their rights as consumers are not fulfilled. <br>This research focuses on discussing the shortcomings of e-toll cards that can cause harm to <br>their users. Furthermore, this research analyzes the importance of legal protection for e-toll card <br>users as a non-cash payment instrument. In addition, this research also analyzes the ideal legal <br>protection recommendations for e-toll card users based on the maslahah mursalah perspective. <br>The research method used is normative legal research with a legal and conceptual approach. The <br>results of this study show that there is a legal vacuum in Bank Indonesia Regulation (PBI) No. <br>20/6/2018 on electronic money, as it does not provide adequate security for e-toll cards, which <br>fall under the category of unregistered electronic money. Legal protection for e-toll card users is <br>very important because the rights related to convenience, security, and compensation for e-toll <br>card users have not been fully met. Therefore, the ideal legal protection recommendations for <br>e-toll card users from the perspective of maslahah mursalah are to change the e-toll card system <br>to be registered, to provide a password or PIN on the e-toll card, to revise the standard clause <br>to provide compensation for damage or loss of e-toll cards, and to provide facilities through <br>digital wallet applications (e-wallet). To realize these recommendations, of course, government <br>awareness is needed to be more assertive in determining policies.</p> <p>&nbsp;</p> <p>Abstrak<br>Transaksi di jalan tol yang awalnya menggunakan pembayaran tunai, kini telah berubah <br>menjadi non-tunai dengan menggunakan kartu e-toll. Kartu e-toll dianggap lebih efisien karena memungkinkan transaksi lebih cepat dan mengurangi kemacetan di jalan tol. Walaupun demikian, <br>kartu e-toll merupakan uang elektronik unregistered yang tidak dilengkapi dengan password atau <br>PIN. Keadaan ini menyebabkan penerbit kartu e-toll tidak dapat memberikan ganti rugi jika kartu <br>e-toll mengalami kerusakan atau kehilangan. Akibatnya, pengguna kartu e-toll dirugikan dan <br>tidak terpenuhi haknya. Penelitian ini fokus membahas kekurangan pada kartu e-toll yang dapat <br>menyebabkan kerugian bagi penggunanya. Selanjutnya, penelitian ini mengungkap pentingnya <br>perlindungan hukum bagi pengguna kartu e-toll sebagai alat pembayaran non-tunai. Selain itu, <br>penelitian hendak memberikan rekomendasi perlindungan hukum yang ideal terhadap pengguna <br>kartu e-toll berdasarkan perspektif maslahah mursalah. Metode penelitian yang digunakan adalah <br>yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian ini <br>menunjukkan bahwa terdapat kekosongan hukum dalam Peraturan Bank Indonesia (PBI) nomor <br>20/6/2018 tentang uang elektronik, karena belum memberikan keamanan yang memadai untuk <br>kartu e-toll sebagai uang elektronik unregistered. Perlindungan hukum bagi pengguna kartu e-toll <br>sangat penting dalam rangka memenuhi hak-hak terkait kenyamanan, keamanan, dan ganti rugi <br>bagi pengguna kartu e-toll yang belum terpenuhi. Oleh karena itu, rekomendasi perlindungan <br>hukum yang ideal terhadap pengguna kartu e-toll dalam perspektif maslahah mursalah yaitu, <br>mengubah sistem kartu e-toll menjadi terdaftar, memberikan password atau PIN, merevisi klausula <br>baku dengan memberikan ganti rugi atas kerusakan atau kehilangan kartu e-toll dan menyediakan <br>fasilitas aplikasi dompet digital (e-wallet). This research aims to reconstruct Islamic education for adults using <br>Mezirow’s transformative learning theory. This research uses a systematic literature review <br>method by collecting journal articles that match the theme raised and filtering them until they <br>become the main material for reviewing this paper. The research results show that Mezirow’s <br>transformative learning theory can be used to reconstruct Islamic education for adults by applying <br>ten phases/steps in it which have a significant influence on students’ cognitive, emotional and <br>social abilities which is in accordance with Islamic culture. So the use of this theory in learning <br>at various levels of education needs to be considered.<br>Abstrak<br>Andragogi Islam di Indonesia mengalami kejenuhan dengan pola religius pragmatisnya, <br>mengingkan sebuah pembaruan dalam meingterpretasikan nilai agama dengan pendekatan yang <br>berbeda khusunya di bidang pendidikan yang menentukan arah masa depan, teori pembelajran <br>transformatif Mezirow melakukan terobosan dengan merekonstruk nilai yang ada pada diri <br>seseorang melalui pengalaman nyata yang dilaluinya. The idea also pioneered the establishment of smart <br>contracts to provide a sense of trust and security when doing activities with others. Quube is one <br>of the e-commerce that utilizes smart contracts and has been used in Indonesia. However, what <br>is an obstacle is that regulations have not been found regarding the validity of smart contracts <br>in buying and selling transactions. Therefore, the author wants to study the validity of smart <br>contracts on the Quube platform with the theory of buying and selling and greeting contracts. So <br>that people can take advantage of emerging technology by always prioritizing sharia principles in <br>every use. This research uses qualitative methods with the results that smart contracts in Quube <br>e-commerce are analyzed using ba’i theory and the contract of salam the validity of the contract <br>is considered valid because of the fulfillment of the terms and pillars of buying and selling salam <br>contracts. With the advantages of providing benefits, security, cost-effective and time for users.<br>Abstrak<br>Tingginya kejahatan saat melakukkan transaksi jual beli pada platform e-commerce membuat <br>kurangnya kepercayaan masyarakat terhadap e-commerce. Gagasan tersebut juga mempelopori <br>dibentuknya smart contract untuk memberi rasa kepercayaan dan keamanan saat melakukan <br>aktivitas dengan orang lain. Quube merupakan salah satu e-commerce yang memanfaatkan smart <br>contract dan telah digunakan di Indonesia. Namun yang menjadi hambatan belum ditemukannya <br>peraturan mengenai keabsahan smart contract pada transaksi jual beli. Oleh sebab itu Penulis ingin <br>mengkaji keabsahan smart contract pada platform quube dengan teori jual beli dan akad salam. <br>Agar masyarakat bisa memanfaatkan teknologi yang sedang berkembang dengan senantiasa <br>mengedepankan prinsip syariah disetiap penggunaanya. Penelitian ini menggunakan metode <br>kualitatif dengan hasil bahwa smart contract pada e-commerce Quube dianalisa menggunakan <br>teori ba’i dan akad salam keabsaahan berkontrak dianggap sah karena terpenuhinya syarat dan rukun jual beli akad salam. As Islam views <br>the economy by looking at the practices that have been carried out by the Prophet Muhammad, <br>his family and companions who have conducted cross-country trade in the Arabian Peninsula, <br>the border areas of Yemen, Bahrain, Syria and others. The problem arises that export activities <br>are lower than imports, causing the trade balance to be negative, the exchange rate and people’s <br>purchasing power to decline so that it can affect economic growth. Economic growth cannot <br>be far from economic development, because economic development encourages economic <br>growth, and conversely economic growth will facilitate the process of economic development. <br>This article discusses the role of international trade for Indonesia’s economic growth from an <br>Islamic perspective using the literature review method. It can be seen that Indonesia’s economy <br>has improved in 2022. This can be seen from the increase in export and import activities that are <br>being carried out by Indonesia and the increase in national income as indicated by the value of <br>GDP obtained by Indonesia. Exports carried out by Indonesia are one of the steps to increase <br>the country’s national income, thus the economy can grow and improve in the future.</p> <p><br>Abstrak<br>Suatu negara dikatakan sukses dan berhasil terpresentasikan melalui laju kecepatan pertumbuhan <br>ekonominya yang tinggi, hal itu dapat dicapai dengan salah satunya ialah melalui kegiatan ekspor <br>dan impor. Sebagaimana Islam memandang ekonomi dengan melihat praktik yang telah di lakukan <br>oleh Rasulullah SAW, keluarga dan para sahabatnya yang telah melakukan perdagangan lintas <br>negara di Jazirah Arab, wilayah perbatasan Yaman, Bahrain, Syria dan lainnya. Permasalahannya <br>muncul kegiatan ekspor ternyata lebih rendah dari impor sehingga menyebabkan neraca <br>perdagangan menjadi negatif, nilai tukar serta daya beli masyarakat menurun sehingga hal tersebut dapat berpengaruh terhadap pertumbuhan ekonomi. Pertumbuhan ekonomi (economic <br>growth) tidak bisa jauh dari pembangunan ekonomi, sebab pembangunan ekonomi mendorong <br>terjadinya pertumbuhan ekonomi, dan sebaliknya pertumbuhan ekonomi akan memperlancar <br>jalannya proses pembangunan ekonomi. Artikel ini mendiskusikan tentang peranan perdagangan <br>internasional bagi pertumbuhan ekonomi Indonesia perspektif Islam menggunakan metode <br>literature review. Marketing management is very necessary in universities to build <br>a positive image in maintaining consumer satisfaction. The aim of this research is to describe <br>the marketing of educational services in improving the existence and image of educational <br>institutions, as well as the implementation of the 7P marketing mix at the Faculty of Islamic <br>Economics and Business IAIN Ponorogo. This qualitative descriptive research chose the FEBI <br>IAIN Ponorogo object because it has innovation and product differentiation for graduating <br>students. Interview techniques with internal parties supported by observation and documentation <br>are tools for exploring data. Interactive model analysis is carried out with the stages of data <br>reduction, data presentation and drawing conclusions. The first research finding, the educational <br>service mix strategy is a service activity that aims to maintain customer satisfaction through <br>excellent service, providing quality education and learning, strengthening character education to <br>produce competitive graduates. secondly, the Faculty of Islamic Economics and Business IAIN <br>Ponorogo applies the 7P marketing mix, namely product, promotion, location, price, people, <br>process and infrastructure as a marketing mix strategy to produce graduates of sharia bankers, <br>sharia accountants and sharia microeconomic developers who are internationally competitive <br>and have excellence, competitive, supported by the availability of lecturers, educational staff, <br>infrastructure, various types and programs to develop student talents and interests, affordable <br>costs, and use of digital platforms.</p> <p><br>Abstrak<br>Persaingan antar institusi pendidikan tinggi memerlukan kepemimpinan biaya secara keseluruhan, <br>diferensiasi produk, dan fokus pengguna. QURAISH SHIHAB https://jurnal.iainponorogo.ac.id/index.php/muslimheritage/article/view/7661 <p>&nbsp;Abstract<br>M. Quraish Shihab, a renowned scholar, in his book "Perempuan," states that nikah mut'ah <br>can be accepted in emergency and urgent situations with certain limitations and conditions, <br>such as it must be conducted with honorable women. This statement has sparked controversy, <br>prompting an examination of the views of the Indonesian Ulema Council (MUI) leaders in <br>Malang City regarding the boundaries of nikah mut'ah from M. Quraish Shihab's perspective. <br>This study aims to understand the permissible boundaries of nikah mut'ah according to M. <br>Quraish Shihab and the perspectives of MUI leaders in Malang City regarding his fatwa on the <br>permissibility of nikah mut'ah. This research is an empirical juridical study with a qualitative <br>descriptive approach, gathering data through interviews and documentation from primary and <br>secondary sources. The data processing involves editing, classification, verification, analysis, and <br>conclusion drawing. The results indicate that the MUI leaders interviewed do not agree with the <br>permissibility of nikah mut'ah based on "emergency or urgent" as its boundaries. They argue <br>that the emergency concept proposed by M. Quraish Shihab does not apply in this context and <br>emphasize the existence of alternative ways to prevent adultery. Additionally, they highlight the <br>negative impacts of nikah mut'ah, especially on women, including the lack of legal protection <br>and the risk of transmitting dangerous diseases such as HIV. The study concludes that although <br>M. Quraish Shihab outlines certain limitations for the permissibility of nikah mut'ah, the MUI <br>leaders in Malang City tend to reject this practice in all situations.<br>Abstrak<br>M. Quraish Shihab, seorang ulama terkenal, dalam bukunya “Perempuan,” menyatakan bahwa <br>nikah mut’ah dapat diterima dalam situasi darurat dan mendesak dengan batasan dan syarat <br>tertentu, seperti harus dilakukan dengan wanita yang terhormat. Pernyataan ini menimbulkan <br>kontroversi, sehingga menarik untuk mengkaji pandangan Tokoh Majelis Ulama Indonesia <br>(MUI) Kota Malang mengenai batasan nikah mut’ah dalam perspektif M. Quraish Shihab. <br>Penelitian ini bertujuan untuk memahami batas-batas kebolehan nikah mut’ah menurut M. <br>Quraish Shihab dan pandangan Tokoh MUI Kota Malang terhadap fatwa tersebut. Penelitian ini merupakan studi yuridis empiris dengan pendekatan deskriptif kualitatif, mengumpulkan <br>data melalui wawancara dan dokumentasi dari sumber data primer dan sekunder. Proses <br>pengolahan data meliputi teknik edit, klasifikasi, verifikasi, analisis, dan penarikan kesimpulan. <br>Hasil penelitian menunjukkan bahwa para tokoh MUI yang diwawancarai tidak sepakat dengan <br>pembolehan nikah mut’ah berdasarkan “darurat atau mendesak” sebagai batasannya. Mereka <br>berpendapat bahwa konsep darurat yang dikemukakan oleh M. Quraish Shihab tidak berlaku <br>dalam konteks ini dan menekankan adanya alternatif lain untuk mencegah perbuatan zina. <br>Selain itu, mereka menyoroti dampak negatif dari nikah mut’ah, terutama terhadap kaum wanita, <br>termasuk kurangnya perlindungan hukum dan risiko penularan penyakit berbahaya seperti HIV. <br>Kesimpulan penelitian ini menunjukkan bahwa meskipun M. Quraish Shihab mengemukakan <br>batasan-batasan tertentu untuk kebolehan nikah mut’ah, pandangan tokoh MUI Kota Malang <br>cenderung menolak praktik ini dalam segala situasi.</p> Shinta Nurul Arfiana Abd. This journal exists to investigate how the two Islamic legal concepts <br>of ta’zir and tawidh are applied in murabahah financing. This case study was conducted at Bank <br>Syariah Indonesia Surabaya Sub-Branch Office, Sunan Ampel State Islamic University (BSI KCP <br>Surabaya UINSA) with the aim of finding out how Islamic banks handle late payments for <br>murabahah financing customers. Apart from that, if it cannot be handled, legal action will be <br>taken by the bank regarding the problem. Field research was involved by the author because <br>this journal uses qualitative methods. Interviews from BSI KCP Surabaya UINSA employees, <br>observations, and analysis of various related books and journals became data collection techniques <br>from the research conducted by the author. This journal concludes that BSI KCP Surabaya <br>UINSA more often uses the ta’zir concept to handle defaulting customers. In addition, this bank <br>is trying to offer other options to its customers who are experiencing financial problems.<br>Abstrak<br>Ta’zir dan tawidh diterapkan apabila terdapat nasabah lalai dalam membayar angsuran pembiayaan <br>yang diajukan di lembaga perbankan syariah. Jurnal ini hadir guna menyelidiki bagaimana dua <br>konsep hukum Islam ta’zir dan tawidh diterapkan dalam pembiayaan murabahah. Studi kasus <br>ini dilakukan di Bank Syariah Indonesia Kantor Cabang Pembantu Surabaya Universitas Islam <br>Negeri Sunan Ampel (BSI KCP Surabaya UINSA) dengan tujuan untuk mengetahui bagaimana <br>bank Islam menangani keterlambatan pembayaran nasabah pembiayaan murabahah. Selain <br>itu apabila tidak bisa ditangani terdapat tindakan hukum yang diambil oleh pihak bank terkait <br>permasalahan tersebut. Penelitian lapangan dilibatkan oleh penulis karena jurnal ini menggunakan <br>metode kualitatif. Wawancara dari pegawai BSI KCP Surabaya UINSA, pengamatan, serta analisis <br>berbagai buku maupun jurnal yang berkaitan menjadi teknik pengumpulan data dari penelitian <br>yang dilakukan penulis. Penelitian ini menyimpulkan bahwa BSI KCP Surabaya UINSA lebih <br>sering menggunakan konsep ta’zir untuk menangani nasabah wanprestasi.
